Terms of Service

SongPort is provided by On The Bright Side VOF, Joos van den Steenelei 58, 2100 Deurne, Belgium, enterprise number 1041.342.114 ("we"). You can reach us at hello@songport.link.

These terms apply to everyone who uses songport.link, SongPort links or the SongPort API (together "the service"). They only cover SongPort, not the other activities of On The Bright Side.

If you take a paid plan or an API key, the API Terms and the Acceptable Use rules also apply. If those documents say something different from this one, they take precedence.

By using the service, you accept these terms. If you create an API account, you accept them explicitly by ticking a box (see article 12 of the API Terms).

SongPort turns a link to a track or album on a streaming platform into one link that opens it on the listener's platform of choice. We don't host, sell or manage any music. We find the right match using public data from the platforms.

That match isn't always correct or complete. A platform can remove a track, offer it in a different version or describe it differently. Check the link if it matters to you that it is right.

SongPort uses the public services of Spotify, Apple Music, YouTube, TIDAL, Deezer, SoundCloud, MusicBrainz and Odesli, among others. When you open a link on one of those platforms, that platform's terms apply. This includes the following APIs: YouTube API Services.

By using SongPort, you also agree to the YouTube Terms of Service and acknowledge the Google Privacy Policy.

SongPort is not affiliated with, sponsored by or endorsed by any of those platforms. Brand names and logos belong to their owners.

We can add a platform to the service or remove it at any time, for example when the platform changes its rules or its access.

You may not use the service to:

• infringe copyright, trademark rights or other rights;
• overload the service, get around its limits or test its security without our written permission;
• collect data in bulk outside the API (scraping);
• break the terms of a third-party platform;
• spread misleading, unlawful or harmful content through SongPort links.

We may remove links and block access in case of abuse.

The software, design, name and logo of SongPort belong to us. You get a personal, non-exclusive right to use the service under these terms. You're free to share the SongPort links you make.

Data about music (titles, artists, cover art) belongs to the platforms or the rights holders. We don't give you any rights to it.

We do our best to keep the service available and correct, but we don't promise any particular availability. The service can be temporarily unavailable because of maintenance, outages at our end or at our suppliers, or changes at a platform.

We may change, limit or stop the free service at any time.

The free service is provided as it is. To the extent the law allows, we are not liable for damage caused by using the free service or by not being able to use it, such as a wrong or broken link.

This limitation does not apply to damage caused by intent, gross negligence or fraud by us or by people working for us, to damage to life or health, or to anything the law does not allow us to exclude. If you're a consumer, you always keep the rights that consumer law gives you.

For paid plans, the rules are in article 10 of the API Terms and, for a paid plan for an artist page, in article 18 of the Terms for Artist Pages.

How we handle personal data is described in our Privacy Policy.

We can change these terms. The current version is always at songport.link/terms, with its version number and the date it takes effect. We announce material changes by email at least 30 days in advance to everyone who has an account. For API customers, article 12 of the API Terms also applies: if you don't accept the new version, you can't use the API after it takes effect.

Send a complaint to hello@songport.link. We reply within 10 working days.

Belgian law applies to these terms.

If you're a business, only the courts of Antwerp, Antwerp division, have jurisdiction.

If you're a consumer, you keep the protection of the mandatory rules of the country where you live, and you can also take a dispute to the court where you live. You can also turn to the Belgian Consumer Mediation Service (consumentenombudsdienst.be).
